Cleveland Doan LLP Personal Information Protection Policy

Cleveland Doan LLP, Barristers & Solicitors, are committed to the highest level of personal information protection. This Personal Information Protection Policy is a statement of our policies respecting our collection, use, disclosure and protection of your personal information.

Personal Information
Throughout this policy "personal information" means any information about an identifiable individual other than that individual=s name, position or title, business telephone number, business address, business email or business fax number.

Protection
Since we are a business and a law firm we are required to protect your personal information under the provisions of the Personal Information Protection Act, the Legal Profession Act and the Law Society of British Columbia=s Rules and Code of Conduct. Upon request, our Privacy Officer will provide you with the particulars of any of the above-mentioned legislation.

Reasons for Collection of Personal Information
In general we will collect personal information from you in order to provide you with legal advice and carry out the tasks and transaction you retain us to assist you with. The information provided by you may also be used to obtain information from and file documents with government agencies, seek advice and assistance from other professional advisors on your behalf and to collect overdue accounts. We may also use it to contact you to advise you about changes in the law.

Consent
If consent is required for the collection, use or disclosure of personal information we will attempt to obtain express consent. Individuals may, at any time request to withdraw their consent by writing to our privacy officer. In any event, your retaining us to act on your behalf will be considered your consent to obtain, use and distribute your personal information in accordance with the nature of the work we are engaged to do on your behalf and as necessary to properly advise and respect you.

On occasion and in the course of representing a client we collect information about people who are not our clients. When doing so we collect such information in accordance with the Personal Information Protection Act.

The Act deems that an individual has consented to our collection, use or disclosure of personal information about that individual if, at the time the consent is deemed to be given, the purpose would be considered obvious to a reasonable person. In such circumstances, we will collect, use or disclose personal information without obtaining a written or verbal consent to do so.

Handling of Personal Information
In dealing with personal information (including employee personal information) we will comply with the provisions of the Personal Information Privacy Act and the regulations thereto. Specific instructions have been given to staff members with regard to the handling of personal information. Such instructions are supplemental to this general policy.

Access to Personal Information
Any person may request to access their personal information in our possession by writing to our privacy officer. We will attempt to respond to any such request within 30 days. However, we may, if your are not a client of this firm, be unable to fulfil all requests because we are not permitted to disclose certain personal information in our possession because it is protected by solicitor-client privilege. You may also request that we correct any personal information about you which we leave on file.

Complaints
An individual may make a complaint about the privacy practices of Cleveland Doan LLP by writing to our privacy officer. Our privacy officer will investigate all such complaints and will attempt to respond to all such complaints within 30 days.
